📜 Acceptance of Terms

By downloading, installing, or using the Happiness Booster application ("App"), you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you ("User", "you") and Happiness Booster ("we", "our", "us") regarding your use of the App.

📱 Description of the App

Happiness Booster is a personal wellness and mood tracking application that helps you monitor your emotional well-being, build healthy habits, journal your thoughts, and receive AI-powered wellness suggestions. The App integrates with Apple HealthKit to provide personalized insights.

👤 Eligibility

You must be at least 13 years of age (or the minimum age required by the laws of your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

If you are a parent or guardian using the App on behalf of a minor, you accept these Terms on their behalf and are responsible for their use of the App.

🔑 License & Intellectual Property

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App on any Apple device that you own or control, subject to these Terms and the Apple App Store Terms of Service.

You agree not to:

• Copy, modify, distribute, or create derivative works based on the App
• Reverse engineer, decompile, or disassemble the App
• Sell, resell, rent, lease, or sublicense access to the App
• Use the App for any commercial purpose without our prior written consent
• Remove or alter any proprietary notices, labels, or marks on the App

All content, trademarks, logos, designs, and intellectual property within the App remain the exclusive property of Happiness Booster and are protected by applicable intellectual property laws.

💎 Subscriptions & Purchases

The App may offer premium features through in-app subscriptions or one-time purchases ("Premium Features"). All payments are processed by Apple through the App Store.

• Auto-Renewal — Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
• Payment — Your Apple ID account will be charged upon confirmation of purchase and at the start of each renewal period
• Management — You can manage or cancel your subscription through your Apple ID settings at any time
• Refunds — Refund requests are handled by Apple in accordance with their refund policies

We reserve the right to change subscription pricing or features at any time. Any price changes will apply to the next billing cycle following notice.

🤖 AI-Generated Content

The App includes an AI wellness coach feature that provides suggestions and responses based on your input. You acknowledge and agree that:

• AI-generated content may be incomplete, inaccurate, or unsuitable for your specific situation
• AI content is provided for informational and educational purposes only and does not constitute professional advice
• You assume full responsibility for any actions or decisions made based on AI suggestions
• AI responses should never replace professional medical, psychological, or therapeutic advice

✅ Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates any applicable law or regulation
• Attempt to gain unauthorized access to the App's systems or infrastructure
• Interfere with or disrupt the integrity or performance of the App
• Use the App to develop a competing product or service
• Use any automated means to access or interact with the App

🔗 Third-Party Services

The App may integrate with or rely on third-party services, including but not limited to:

• Apple HealthKit — for reading health and fitness data with your permission
• AI Service Providers — for powering the AI wellness coach feature
• Apple App Store — for processing payments and subscriptions

We are not responsible for the availability, accuracy, or practices of third-party services. Your use of third-party services is governed by their respective terms and privacy policies.

The App is designed to support your general wellness and emotional well-being. However:

• The App does not replace personalized medical or psychological advice
• Mood scores, happiness metrics, and wellness suggestions are approximate and for informational purposes only
• The App cannot monitor medical conditions or respond to emergencies
• Any significant changes to your mental health routine should be discussed with a healthcare professional

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, secure, or that any defects will be corrected. We do not guarantee the accuracy or completeness of any content provided through the App.

🚫 Limitation of Liability

To the maximum extent permitted by applicable law, Happiness Booster and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, goodwill, or profits, arising out of or in connection with your use of the App.

Our total liability for any claims arising from or related to the App shall not exceed the total amount you paid for Premium Features within the six (6) months preceding the claim.

You agree to indemnify, defend, and hold harmless Happiness Booster, its developers, affiliates, and their respective officers, directors, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of a third party

🔚 Termination

You may stop using the App and terminate this agreement at any time by uninstalling the App from your device. Upon termination, all locally stored data will be permanently deleted.

We reserve the right to suspend or terminate your access to the App at any time, without prior notice, if we reasonably believe you have violated these Terms or if continued access poses a risk to the App or other users.

📝 Changes to These Terms

We may update these Terms from time to time. Any changes will be reflected by updating the "Effective Date" at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.

⚖️ Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Georgia, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in Tbilisi, Georgia.
